Congratulations to Katherine R. Woods and Christopher J. Mueller on securing final summary judgment in a construction defect case in Nassau County.
The case involved a builder’s derivative claims against subcontractors arising from a construction defect claim asserted by a homeowner against the builder. At the conclusion of discovery and just weeks before the scheduled trial, the Court found the client’s work was not implicated in the underlying action against the builder and that the builder failed to present evidence to show the client’s work was otherwise deficient.
Final judgment has been entered in the client’s favor. And because the builder did not accept a Proposal for Settlement earlier in the case, the firm will seek recovery of the client’s attorneys’ fees and costs.
