John Kessenich and Nathaniel Carr recently obtained a favorable verdict for clients after a one-week trial in an auto accident matter in Alachua County, Florida. The Plaintiff had extensive medical treatment after the accident, including injections and a lumbar fusion surgery. Plaintiff was further recommended for a future second lumbar fusion surgery. The Defense admitted liability but strategically focused on the Plaintiff’s various chronic health conditions as the actual cause of his alleged ongoing pain and need for surgery.
At the close of the case, the Plaintiff asked the jury for $3 million in damages, including past medical expenses, future expenses, and pain and suffering. The Defense suggested the jury could find the Plaintiff was not injured in the accident, or at worst suffered a muscle strain that cost $18,000 to receive medical care for. Ultimately, the jury determined the Plaintiff was not injured as a result of the accident and returned a complete defense verdict. This result will trigger the Defense’s multiple pre-trial Proposals for Settlement.
