Theresa Sanders Obtains Final Summary Judgment in Premises Liability Case

Premises liability summary judgment

Theresa Sanders recently secured a final summary judgment in favor of a veteran-owned, family-operated flooring company based in Orange County, Florida.

The plaintiff alleged she slipped and fell on glue in a hallway where new carpeting was being installed, claiming the defendant failed to maintain the area and created an unreasonably dangerous condition. Through effective use of deposition testimony, Theresa established that the alleged hazard was open and obvious. The plaintiff herself admitted during deposition that the glue was visible prior to the fall.

Relying on this evidence, Theresa successfully argued that the defendant could not be held liable for injuries resulting from an open and obvious condition. The court agreed, granting final summary judgment in favor of the firm’s client.
